GENERAL TERMS AND CONDITIONS OF TRAVEL

1. General Provisions and Integral Parts of the Agreement
These General Terms and Conditions regulate the mutual relations between the agency BUDANKO TRAVEL j. d. o. o. from Makarska (hereinafter: Agency/Travel Organizer) and the Traveler.

Integral parts of the Agreement: The Travel Program, Individual Travel Program, and these General Terms.

Order of Application: Agreement → Travel Program → Individual Travel Program → General Terms.

Binding Nature: The Agreement is considered binding once signed by both parties. By paying a deposit or providing personal data, the Traveler fully accepts these General Terms.
2. Definitions

Organizer: Budanko travel j. d. o. o., Makarska (MBS 060513936).

Package Travel (Package): A combination of at least two services (transport, accommodation, activities) lasting more than 24 hours or including an overnight stay.

Voucher: A written document confirming the Traveler's right to the agreed services.

Subagent: A third party through whom the Organizer promotes or sells travel.
3. Pre-contractual Information and Documents

Conclusion of Agreement: The agreement is concluded when the Traveler confirms consent (written/email/online) and pays the deposit.

Traveler Obligations: The Traveler is responsible for having valid travel documents (passports/visas) and complying with health formalities of the destination country.
4. Data Protection (GDPR)
In accordance with Regulation (EU) 2016/679, the Agency collects and processes data solely for the realization of services. Data is shared only with necessary partners (airlines, hotels, insurers).

5. Price and Content of the Package

Included: Services explicitly stated in the Program (usually transport, accommodation, and statutory insurance).

Not Included: Airport taxes, visa costs, entrance tickets, optional excursions, tips, and personal expenses unless stated otherwise.
6. Price Changes
The Agency may increase the price due to changes in fuel costs, taxes, or exchange rates:

Increase up to 8%: Applied without the Traveler's specific consent.

Increase over 8%: Requires written consent from the Traveler. If refused, the Traveler has the right to terminate the agreement with a full refund.

Low-Cost Carriers (LCC): The Agency is not liable for LCC schedule changes or bankruptcy; this risk is borne by the Traveler.
7. Transfer of Agreement
The Traveler may transfer the Agreement to another person who meets the requirements, provided the Agency is notified no later than 7 days before departure. Both parties are solidarily liable for the costs of the transfer.
8. Cancellation by the Agency (Minimum Number of Passengers)
If the minimum number of passengers is not reached, the Agency may terminate the agreement with a full refund within the following notice periods:

20 days before departure (for trips lasting > 6 days).

7 days before departure (for trips lasting 2–6 days).

48 hours before departure (for trips lasting < 2 days).
9. Termination by the Traveler and Cancellation Fees
Termination must be in writing. The following cancellation scale applies:

Up to 30 days before: 20% of the price (min. €26.55).

15–29 days before: 50% of the price.
-
08–14 days before: 75% of the price.
-
00–07 days before: 100% of the price.
10. Responsibility and Liability

Liability: The Organizer is responsible for the proper performance of all services. Liability for damages (excluding personal injury) is limited to three times the total price of the package.

Statute of Limitations: The right to claim a price reduction or compensation expires after two years.
11. Language and Suitability

Language: For group tours, the tour leader speaks Croatian (unless stated otherwise). Other services are provided in Croatian or English.

Mobility: Services are generally not suitable for persons with reduced mobility unless explicitly indicated.
12. Complaints and Claims Procedure

Immediate Notification: Irregularities must be reported on-site to the service provider or tour leader.

Written Complaint: Must be submitted within 8 days after the trip ends to info@budankotravel.com.

Response: The Agency will respond within 14 to 30 days (depending on the specific program terms).
13. Dispute Resolution
Disputes shall be resolved amicably or through the Mediation Center at the Croatian Chamber of Economy. If no agreement is reached, the court in Makarska has jurisdiction.
